3. Terms of Service

Welcome to ODDAY. These Terms of Service ("Terms") govern your access to and use of shopodday.com and any purchase you make from us (the "Website", operated by ODDAY. By accessing the Website or placing an order, you agree to these Terms. If you do not agree, please do not use the Website.

3.1 Eligibility

You must be at least 18 years of age and capable of entering into a legally binding contract under Indian law to transact on the Website. By placing an order, you confirm that you meet this requirement and that all information you provide is accurate.

3.2 Your account

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Notify us immediately of any unauthorised use. We may suspend or terminate accounts that breach these Terms or are used unlawfully.

3.3 Products, descriptions and colours

We take care to describe and display products accurately. However, slight variations in colour, texture, measurement and appearance may occur due to screen settings, photography and the handmade or natural nature of certain materials. Such minor variations are not defects.

3.4 Pricing, errors and availability

All prices are listed in Indian Rupees (INR) and, where applicable, are inclusive of or subject to GST as indicated at checkout. All products are subject to availability. Despite our best efforts, occasional errors in pricing, descriptions or availability may occur. Where an error is identified, we reserve the right to correct it, and to cancel or decline any order affected by such error, even after an order has been confirmed; any amount already paid for a cancelled order is refunded in full.

3.5 Orders and acceptance

Your order is an offer to purchase. A confirmation message acknowledges receipt of your order but does not constitute acceptance. We reserve the right to accept, decline, limit or cancel any order at our discretion — including for reasons such as stock unavailability, suspected fraud, errors, or breach of these Terms.

3.6 Payment

Payment must be made through the methods offered at checkout. By providing payment information, you confirm you are authorised to use the chosen payment method. Payments are processed by third-party gateways, and your use of them is subject to their terms.

3.7 Shipping, returns and refunds

Delivery of orders is governed by our Shipping Policy, and returns, exchanges, cancellations and refunds are governed by our Return & Refund Policy, both of which form part of these Terms.

3.8 Intellectual property

All content on the Website — including the ODDAY name, logo, designs, product images, graphics, text, and the overall look and feel — is owned by or licensed to ODDAY and is protected by Indian and international intellectual property laws. You may not copy, reproduce, distribute, modify or use any of it for commercial purposes without our prior written permission.

3.9 Acceptable use

You agree not to: use the Website unlawfully or fraudulently; interfere with its operation or security; attempt unauthorised access to our systems or data; upload malicious code; scrape or harvest data; or post content that is unlawful, infringing, defamatory or offensive.

3.10 Reviews and user content

If you submit reviews, photographs, comments or other content, you grant ODDAY a non-exclusive, royalty-free, worldwide licence to use, display and reproduce that content for marketing and operational purposes. You confirm the content is your own and does not infringe any third party's rights. We may remove any content at our discretion.

3.11 Disclaimer of warranties

The Website and its content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties not expressly stated, including warranties of uninterrupted or error-free operation. This clause does not affect the statutory rights you have under the Consumer Protection Act, 2019.

3.12 Limitation of liability

To the maximum extent permitted by applicable law, ODDAY's total liability arising out of or in connection with any order or your use of the Website shall not exceed the amount actually paid by you for the relevant order. We shall not be liable for any indirect, incidental, special or consequential loss. Nothing in these Terms limits liability that cannot be excluded or limited under Indian law.

3.13 Indemnity

You agree to indemnify and hold harmless ODDAY, its owners, employees and partners from any claim, loss, liability or expense arising out of your breach of these Terms or your misuse of the Website.

3.14 Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, strikes, courier disruptions, government action, pandemics, or failures of telecommunications or payment infrastructure.

3.15 Governing law and jurisdiction

These Terms are governed by the laws of India. Subject to Section 3.16, the courts at New Delhi, Delhi shall have exclusive jurisdiction over any dispute.

3.16 Grievance redressal and dispute resolution

Before initiating any formal proceedings, you agree to first raise the matter with our Grievance Officer (see Contact Information) so we can attempt to resolve it amicably. Where a dispute is not resolved within a reasonable time, it shall be subject to the jurisdiction stated above.

3.17 Changes to these Terms

We may revise these Terms from time to time. The current version is always posted on this page. Your continued use of the Website after changes take effect constitutes acceptance of the revised Terms.

3.18 Severability and entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. These Terms, together with our Privacy Policy, Shipping Policy and Return & Refund Policy, constitute the entire agreement between you and ODDAY.
